What is discovery?

A discovery is something that litigants, the parties to a lawsuit, engage in after a lawsuit has been filed. And what that typically involves is written discovery, exchanging written questionnaires and requests for documents, and then moving into the deposition phase where the parties are deposed and the lawyers are entitled to ask the opposing party questions, and then filing any expert discovery that’s necessary. And that is generally what we call discovery, that phase that’s engaged in before the case is actually tried to a jury.
